Services are provided under separate written agreements or service orders. These Terms apply to your general use of this website and any initial engagement communications.

2. Eligibility

You must be at least 18 years old and authorized to enter into binding agreements on behalf of yourself or your business to use our services. By engaging with us, you represent that you meet these requirements.

3. Client Responsibilities

As a client or prospective client, you agree to:

• Provide accurate and complete business information
• Have legal authority to operate the business for which services are requested
• Not use our services for any unlawful purpose or in violation of any regulations
• Maintain confidentiality of any access credentials or proprietary materials we provide

4. SMS Communications

By providing your phone number and agreeing to receive SMS messages, you consent to receive text messages from Klickify Agency related to your service engagement. Message frequency varies. Message and data rates may apply.

We do not use SMS for unsolicited marketing. Messages are sent only in connection with an active or potential service engagement you have initiated.

5. Intellectual Property

All content on klickifyagency.com — including text, graphics, logos, and design — is the property of Klickify Agency and protected by applicable copyright and intellectual property laws.

Work product created for clients (websites, ad copy, creative assets) is transferred to the client upon full payment as specified in the applicable service agreement. We retain the right to display completed work in our portfolio unless otherwise agreed in writing.

6. Results Disclaimer

Digital marketing results depend on many factors outside our control, including search engine algorithm changes, market competition, and client business conditions. We do not guarantee specific rankings, traffic levels, revenue outcomes, or return on ad spend. All projections and case examples represent past or estimated performance and are not promises of future results.

7. Payment Terms

Payment terms, amounts, and schedules are specified in individual service agreements. All fees are non-refundable unless expressly stated otherwise in writing. We reserve the right to suspend services for non-payment after reasonable notice.

8. Limitation of Liability

To the fullest extent permitted by law, Klickify Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the amount paid by you to Klickify Agency in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Klickify Agency, its owner, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights.

10. Third-Party Platforms

Our services may involve operating on third-party platforms (Google, Meta, etc.). Your use of those platforms is governed by their own terms of service. Klickify Agency is not responsible for third-party platform policy changes, account suspensions, or other actions taken by those platforms.

11. Confidentiality

We treat client business information, strategies, and data as confidential and will not disclose them to third parties without your consent, except as required by law or to provide the services you engaged us for.

12. Termination

Either party may terminate a service engagement with written notice as specified in the relevant service agreement. These Terms survive termination with respect to obligations accrued prior to termination and any provisions that by their nature should survive.

13. Governing Law

These Terms are governed by the laws of the State of Mississippi, United States. Any disputes shall be resolved in the courts of Mississippi, and you consent to personal jurisdiction in that venue.

14. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
